What happens if you took and failed the test and do not ask for a hearing or lose at the hearing? Your license will be automatically suspended. The number of DUII's on your record will determine the length of your suspension.

What is "diversion?" Diversion is a process by which a person who has been charged with DUII can avoid prosecution if it is his or her first DUII within 10 years and there was no accident involved that caused injury to another person. If those criteria are met, you may be required to participate in an alcohol education and rehabilitation program instead of being prosecuted.

What if I was involved in an accident? We will make sure the police followed proper procedures. If you and/or others were taken to a hospital, we will check to see that blood draws were done legally and that information was distributed correctly under HIPPA requirements. We will also deal with any civil liability associated with the auto accident in addition to any DUII charges.

DUII charges are serious. In Oregon, misdemeanor DUII can lead to a maximum sentence of one year in jail and a fine up to $6,250 or more. Felony DUII can lead to a maximum sentence of five years in prison and a fine of $125,000. Driving privileges may be suspended for one to three years or revoked for a lifetime.
